When you book, purchase or redeem an Ozball voucher or gift and tick the box accepting our terms and conditions, you become legally bound by these terms and conditions. Please do not proceed and book, purchase or redeem a voucher until you have read, understood and accepted the terms and conditions.

Equality

Ozball recognise that people with disabilities may have difficultly participating in certain experiences and activities that are presented by Ozball on its website and in promotional material. Wherever possible, Ozball endeavour to advise participants of any limitations that apply to specific experiences or activities. To help us meet your needs, we ask that you inform us of any disability when ordering through us. Restrictions on age, health, weight and height will be clearly detailed with each experience confirmation.

If a participant that is not also the purchaser is unable to meet the minimum requirements for the experience we will try to exchange the experience for another with a value equal to or less than the value of the experience purchased. Should an experience be chosen that is of greater value then the participant is required to pay us the difference in value between the two experiences.

Ozball reserve the right to refuse participation in any of our experiences if the purchaser or participant have failed to inform us of any conditions that would make participation in the experience dangerous for themselves or any other party. Liability

Zorbing like many other activities and adventure sports has its own element of risk. OzBall has its own insurance but it is recommended that you consider taking our your own insurance before participating in the Zorbing experience. OzBall accepts no responsibility and shall not be liable for any loss, injury, claim, cost, damage or any consequential damages of any kind. OzBall shall under no circumstances be liable for any delay or failure in performance resulting directly or indirecftly from acts of nature, forces or causes beyond its reasonable control. If any claim arises against OzBall by reason of our wilful act, neglect or default, our liability shall not exceed the price paid to OzBall for the experience. All participants are required to sign a liability release agreement with OzBall before taking part in the Zorbing experience.

Package and Delivery

Vouchers are available as an electronic voucher or e-voucher. From time to time, we may change the contents of our e-voucher.

Following credit card approval or proof of payment, voucher orders and bookings are processed that day and emailed unless a future delivery date is specified during the purchase process. Future date delivery orders are processed and dispatched on the date that you select during the purchase process. Ozball accepts no responsibility for e-vouchers not being delivered. A re-delivery charge of $10 may apply if the email address is incorrect. Ozball are not liable for any loss suffered as a result of a voucher being lost or not arriving on time.

Provision of Venue

Ozball continuously reviews its services, its location of business and the experiences it offers. Occasionally we need to change or withdraw venues or experiences due to circumstances beyond our control. In such cases purchasers and participants of our experiences will be able to exchange their experience voucher for a different experience voucher of the same monetary value.

Experience and Activity Descriptions

Ozball strives to keep all the information on its web site and promotional materal as accurate as possible. However, the exact detail of each experience may change from time to time. All promotional material, pictures, illustrations and description are used as an indication only and do not form the basis or part of the agreement. The most up to date experience descriptions are available on www.ozball.com.au. We reserve the right to make changes to the desciptions that apply to any experience without notice.

The duration of exact experience is an approximation of the length of time the participant will spend at the venue. Details regarding the number of participants, or any wait time that may be involved are listed in the experience description. Wait times are affected by the number of participants attending at the venue. Participants are requested to comply with the roster provided where this would normally be available.

Availability

All Ozball experiences offered are subject to availability. Experiences should be booked a minimum of 2 weeks in advance and even further for weekends and public holidays. Bookings are not confirmed until you have received your booking confirmation (either by email or mail). You should not make any travel or other related arrangements until the experience booking has been confirmed.

Ozball reserve the right to surrogate certain parts of the experience, should those parts become unavailable due to circumstances beyond our control. We may need to cancel the experience at short notice due to changes made that are outside our control. Participants will be able to rebook the experience cancelled by Ozball.

Occassionally, Ozball may withdraw or cancel a venue or experience. If this occurs, Ozball will offer an alternative venue or exchange your experience for an experience with a value equal to or less than the value of the experience you purchased. Any experiences chosen that are of greater value than the initial booking, will require you to pay us the difference in value between the two experiences. However, any exchange we provide is subject to the availability of another experience and is not guaranteed.

Weather

Many of the experiences offered by Ozball are dependant on weather conditions. The experience desciption will include advice about weather conditions and participants may need to confirm with Ozball on the day. A telephone contact number will be provided in your booking confirmation. In the event that the experience is cancelled, participants will be able to re-book directly with Ozball. However, we will not reimburse you for any traveling and other related expenses caused by cancellation due to adverse weather.

Dress Code

Some experiences require that stipulated clothing items be brought to the experience or alternately worn during the experience. Ozball advise the details of any special dress code in the experience desciption. You are requested to comply with these requirements. Ozball will not be held liable if you are refused participation in an experience due to failure to bring or wear the stipulated clothing.

Experience Voucher Conditions

The experience gift voucher or booking is proof of payment. The voucher number will be used to identify the participant in communications with Ozball. Ozball vouchers are non-replaceable and must be presented intact to the Ozball on the day of the experience.

The voucher cannot be exchanged for cash and its face value is valid until the expiry date printed on the voucher. If your voucher has expired and you contact us within 30 days of its expiry we can reactivate it for a further 3 months for an administration fee of $45 per voucher once only. If your voucher has expired and you contact us after 30 days but before 60 days after the expiry of your voucher, Ozball can extend the voucher by a further 30 days from the date of your request for an administration fee of $45 (if the activity has increased in price you will also need to pay the difference in price and subject to experience availability). Vouchers that have an expiry date that is over 60 days old cannot be extended under any circumstances. A voucher will be deemed to be invalid if it is out of date.

All Ozball vouchers are transferable. A voucher can be transferred to a third party providing the voucher has not been redeemed and a booking date has not been requested. Once you redeem your voucher, your voucher cannot be transferred to another recipient.

Vouchers can be exchanged for another experience once only, providing the voucher is still valid has not been redeemed and a booking date has not been requested. If the exchange is for a lower value experience the difference will become the property of Ozball. For higher valued experiences, the voucher can be exchanged for the price of the difference. A voucher cannot be exchanged for cash.

Should the voucher be misplaced, stolen or damaged, Ozball will not under any circumstances replace the voucher. Only original vouchers are accepted. We do not accept photocopies. It is your responsibility to ensure you enter your email address correctly when you register your details with us. E-Vouchers, e-mail booking requests and confirmations are all sent via email. An incorrect email may result in the e-mail being lost in cyberspace because it can’t be delivered. For bookings, we will be expecting you on a date and time specified in the booking confirmation, and you may end up forfeiting your voucher if you do not turn up on the designated date and time.

Refunds and Cancellations

Ozball will process refunds on vouchers provided that the request is made in writing by the puchaser within 28 days of the date purchased and the original voucher is returned intact at the customer cost and received by Ozball within 28 days. In event of a refund, Ozball will deduct an administrative fee of 10% (or minimum of $30) from the amount refunded. Refunds will be made within 30 days of us agreeing with the purchaser that a refund will be made.

No refund is possible for already booked (redeemed) experiences. If you cancel your experience, we may charge you a cancellation fee or charge. If an experience is cancelled Ozball an alternative date should be organised directly with us.

Ozball may, for circumstances beyond our control, need to cancel an experience. Ozball will notify the participant as soon as possible in such cases and offer all available alternatives. We do not refund any expenses incurred relating to the cancelled experience or any other costs you may have incurred such as accommodation and travel costs.

Ozball will re-book, and in limited cases refund the amount paid for an experience due to extreme circumstances such as death, severe injury or severe illness. Participants may be asked to provide documentary evidence to support such claims relating to the above.

Any refunds will be refunded to the original purchaser of the experience and at the discretion of Ozball an administration charge of $50 may be applied.

Complaints

Ozball have taken great care in choosing quality venues and experiences. If you have a problem or complaint on the day, please bring it to the attention of Ozball on the day or as soon as possible thereafter so that they have an opportunity to resolve the complaint. If you are unable to resolve the complaint, please write with you concerns to Ozball at the address at the bottom of this Terms and Conditions. Generally we consider it unreasonable if complaints are not first raised with Ozball on the day.

Copyright and Trademarks

The text, illustrations, data and pictures used in our promotional material and on our web site are protected by copyright and/ or trademarks and must not be copied in whole or in part without the express permission of Ozball.

Ozball provides the site and its contents on an "as is" basis and makes no representations or warranties of any kind, express or implied, with respect to the site or its operation, contents, products or services.
